TERMS AND CONDITIONSBy enrolling your child at Knaves Theatre Company, you accept these terms and conditions ("Terms & Conditions") and sign your agreement to them as an ongoing agreement between you and Knaves Theatre Company ("Agreement").
The Agreement is made between the parent/guardian ("Parent", "you" or "your") of each enrolled student ("Student") by a Parent and Knaves Theatre Company Limited ("Knaves Theatre Company", "we", "our", "us") (trading as Knaves Theatre Company) and is valid at all times whilst the Student is enrolled on any Knaves Theatre Company activity and until such time as written notice is given in accordance with these Terms & Conditions.
INTRODUCTION
These Terms & Conditions apply to all our Knaves Theatre Company Courses, Holiday Workshops, LAMDA Workshops and any additional products and/or services offered by Knaves Theatre Company for any Student (collectively "Knaves Theatre Company Activities")
For participation of a Student in a Knaves Theatre Company Activity all Parents are required to consent to these Terms & Conditions by signature, or on completing the student enrollment form, or by ticking the acceptance box for these Terms & Conditions when submitting an electronic application form online. We may update these Terms & Conditions from time to time.
A "Course" refers to a course of classes offering tuition in drama which will be delivered during the Term (including online activities). Course classes will take place once per week for a certain number of hours, as detailed at the time of booking.
"Holiday Workshop" refers to Workshops or Drama Camps (including online activities) run by Knaves Theatre Company during the breaks between Terms.
"Principal" refers to the principal of a particular Knaves Theatre Company school.
"Term" refers to one normal academic term of Knaves Theatre Company schools during which Courses are run.
"Term Dates" refers to the dates for the relevant Term.
"Workshop" refers to a one-off course (including online activities) offering tuition in drama, and/or other performing arts related activities which will be delivered for a certain number of hours per day for a period of between one (1) and five (5) consecutive days and can run at any time throughout the year.
"Online activity" refers to online streamed lessons and online Workshops utilising the Zoom platform, either delivered by Knaves Theatre Company. See section point 8.7.
ENROLLING A NEW STUDENT IN A KNAVES THEATRE COMPANY ACTIVITY
To apply for a place for a new Student on a Knaves Theatre Company Activity, the Parent must agree to these Terms & Conditions and submit an enrollment form online or by post.
Each Student's place is allocated on a 'first come, first served' basis. Applications must be accompanied by the appropriate payment/transfer.
If Knaves Theatre Company is unable to accept the Student due to capacity reasons, the Student may, at the Parent's discretion, be placed on a reserve list.
Times, current Term Dates, fees and all relevant course details for booked Knaves Theatre Company Activities will be confirmed in the Acceptance Letter or "Fee Note" for each Knaves Theatre Company Activity, along with a receipt for payment of the Deposit.
All such terms and conditions detailed in the Fee Note or the Acceptance shall be incorporated into the Agreement and shall be deemed to have been accepted by the Parent upon payment by, or on behalf of, the Parent.
FEES
Fees to be received BEFORE the first week of each term.
All weeks must be paid for whether your child attends or not.
Discounts are offered to siblings on some courses. If a discount is offered it will be shown on the booking page. The 1st and 2nd sibling discount applies to any course of equal or lower price.
COURSES
A Knaves Theatre Company school may, at its discretion, offer the second child of the same family attending a Main Stage course at the same time, a sibling discount of up to twenty five percent (25%) on Course fees.
Once enrolled on a Course, Term Dates for the next Term will be made known to Parents in writing at the end of the current Term.
If a Course session falls on a bank holiday then a replacement class will also be added onto the end of the current Term timetable or the subsequent Term.
Unless Knaves Theatre Company is otherwise notified in writing by you before the sixth (6th) week of the Course, a Student is automatically re-enrolled onto the Course for the following Term.
If you do not notify Knaves Theatre Company before the sixth (6th) week of the Course that you do not wish a Student to be re-enrolled onto the following Term of the Course, then you will remain liable for half of the full Term fees in respect of the next Term, regardless of attendance of the Student.
Payment is due for the next Term of Course fees before the start date of the Term, subject to any alternative payment agreements you may have with the Principal.
USE OF PERSONAL INFORMATION
The personal data (as it is defined in the Data Protection Act 2018) of a Student and/or Parent will be processed by Knaves Theatre Company, including any group companies and/or the Principal(s) of its franchised schools in accordance with its Privacy Policy, which can be found in our Privacy Policy . A hard copy of the Privacy Policy can be requested from jason@knaves.co.uk.
Knaves Theatre Company owns all the rights, title and interest in and to its websites, including software, text and media and its trade marks, logos and brand elements. Nothing within these Terms & Conditions affects or licences the ownership of these rights. Any intellectual property created during any Course, Workshop or Holiday Workshop is owned by Knaves Theatre Company.
HEALTH AND SAFETY
Students participate at their own risk and are obliged to inform Knaves Theatre Company and its staff of any existing injuries or medical condition. All application forms must have any known medical conditions stated and any changes to such information must be notified to Knaves Theatre Company immediately in writing.
If you are unsure whether a Student should participate in any activity please consult the Student's GP before enrolling the Student on a Knaves Theatre Company Activity.
Any medication left on the school premises must be clearly labelled and the Student should, unless Knaves Theatre Company has agreed in writing otherwise, be able to administer it themselves.
Students must wear suitable footwear and clothing at all times, including Knaves Theatre Company uniform for all Courses.
If a Student is unwell or has an accident requiring emergency treatment, the Parent will be contacted via the emergency contact details provided or on the enrolment form. This number must always be contactable whilst the Student is attending the Knaves Theatre Company Activity.
Parents are solely responsible for ensuring that the emergency contact details on Knaves Theatre Company's records are up to date.
All online activities are recorded and held for a period of four weeks for safeguarding and quality review purposes.
COVID-19
Before the start of a course, if a child is unwell, or has symptoms of Covid-19 and/or tests positive, parents must inform Knaves Theatre Company immediately. The child is not permitted to join the course.
While courses are in attendance, parents must inform Knaves Theatre Company immediately if their child is unwell or has symptoms of Covid-19 and/or tests positive. The child will not be able to continue to attend from this point.
If a Knaves Theatre Company staff member becomes unwell and/or develops symptoms of Covid-19 and/or tests positive, they will not come to the venue; the course will either continue at the venue with a different teacher, or via Zoom, where possible, or credit notes will be issued for full, unspent days.
If there is a national or local lockdown and the course cannot continue it will either be cancelled, and credit notes issued for full, unspent days, or it may continue via Zoom where possible, at the discretion of Knaves Theatre Company. Please note, we do not offer refunds.
If a child cannot attend a Holiday Course due to COVID-19, we will provide a credit note for any full, unspent days, at Knaves Theatre Company's discretion. We do not offer refunds.
PERSONAL PROPERTY
Students are obliged to take care of their own belongings. Knaves Theatre Company can accept no liability for lost or damaged belongings.
You acknowledge that the maximum aggregate liability of Knaves Theatre Company to a Student or Parent under these Terms & Conditions shall not exceed the Knaves Theatre Company Activity fee to which a claim relates.
The liability of Knaves Theatre Company and that of its staff is restricted to class time only and then only to gross negligence.
GENERAL
Knaves Theatre Company may, at its own discretion, refuse a Student entry to a Knaves Theatre Company Activity or session of a Knaves Theatre Company Activity if it is felt that the Student's behaviour is unacceptable
Knaves Theatre Company reserves the right to make changes to the timetable, the teaching staff, the advertised programme or the programme delivery mechanism (for clarity this may mean that we switch to online zoom classes) in the event of illness or other circumstances beyond our control.
Where a session of a Knaves Theatre Company Activity has to be cancelled by Knaves Theatre Company, Principals will give as much notice as possible. In the event of a last minute session cancellation, you will be notified by email, text message, a call to your mobile phone or through a designated Knaves Theatre Company social media site. Parents must ensure that they provide their Principal with up-to-date contact details.
In the event of a Knaves Theatre Company Activity being cancelled, Knaves Theatre Company will provide substitute lessons where possible either at an alternative time, venue or online. If no alternative can be offeredby Knaves, then Knaves Theatre Company will provide refunds for lessons that are unable to be fulfilled. If a student is unable to attend any of the substitute lessons provided by Knaves, all refund claims become void.
It is occasionally necessary to change the time and/or venue of a Knaves Theatre Company Activity session. This will only be done if absolutely necessary and Knaves Theatre Company will do its best to keep class times, programme delivery mechanisms and/or locations as similar as possible but unfortunately this cannot always be guaranteed.
In the event that a Student is unable to attend a Knaves Theatre Company Activity session, due to sickness, holiday or a decision by the Parent or Student not to attend, Knaves Theatre Company regrets that it is unable to refund any payment.
All Students must be collected on time after a session. Knaves Theatre Company is unable to supervise Students after a session and consistent late collection will result in additional charges.
In the event a Knaves theatre performance is postponed, tickets will remain valid and will transfer to the alternative date. Ticket refunds cannot be refunded under any circumstances.
KNAVES THEATRE CLUB
Theatre tickets purchased through Knaves are at substantially reduced rates.
Tickets will be emailed to you as soon as Knaves has received them from the box-office, usually at the latest one week before the show.
If the ticket purchaser or anyone in their party is unable to attend a performance, refunds will not be made. It is the responsibility of the purchaser to pass on or sell their tickets to someone else.
In the event a performance is cancelled and cannot be rescheduled then the price of the tickets will be refunded to the purchaser, minus a small banking charge to process the refund.
Knaves Theatre Company Activity fees are reviewed annually and may be increased each year.
These Terms & Conditions, together with any Fee Note, enrollment form, or Acceptance Letter, constitute the entire agreement between the parties which supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
In the event that one or more of the provisions of the Agreement are found to be unlawful or otherwise unenforceable, those provisions shall be deemed severed from the remainder of the Agreement.
The Agreement shall be governed by, and construed in accordance with, the laws of England and Wales and any dispute, proceedings or claim shall fall within the jurisdiction of the English courts.
